Owner of Waste Service Company Accused of Illegal Dumping in Hillsborough

The man promised to clean up the site, but did not, Hillsborough sheriff’s deputies said.

HILLSBOROUGH COUNTY – The owner of two waste service companies is accused of illegally dumping debris, the Hillsborough Sheriff’s Office said.

Robert Rogan, 50, of 5023 Montgomery St. in Tampa, was charged with illegal commercial dumping, a felony. Additional charges are pending, deputies said. Rogan is being held without bail.

Deputies said they received two anonymous complaints of illegal dumping on property at 10716 Broadway Ave. in Tampa. The complainants said there has been dumping at the site for about six months.

During the course of the investigation, detectives conducted surveillance at the property and said they found out that American Waste Services brought in 40 yard dumpsters onto the property and dumped debris on 39 occasions.

On Jan. 4, deputies stopped a truck hauling an empty waste roll off that was pulling out of the property. Deputies said it was driven by Rogan, the owner of American Waste Services and Payless Waste Services. Rogan had made a deal to bring the debris onto the property for $100 a load, deputies said. The debris would later be burned.

Deputies and officials from the environmental protection commission met with the property owners and issued them a cease and desist order. Rogan, they said, agreed to remove the trash from the site.

Deputies also met with prosecutors with the Hillsborough County State Attorney’s Office to review their findings. The SAO decided not to file charges until the site had been cleaned, in part because of concerns that Rogan might stop the clean up. If that happened, the county would have needed a court order to go on private property for the cleanup, which would cost more than $250,000.

Deputies and Hillsborough code enforcement investigators when back out to the property Tuesday (Feb. 14) to check on the progress of the clean up. Deputies said the area was not clean and no discernible progress had been made.

Deputies again met with the state attorney’s office, which authorized them to file charges and arrest Rogan. Rogan was on felony probation for grand theft, deputies said.

The sheriff’s office said the EPC, Hillsborough County Health Department, Hillsborough code enforcement, and Hillsborough mosquito control helped in the investigation. Each agency has opened its own investigation, deputies said, since the beginning of his investigation. Each of those agencies have opened its own investigation.
