Deputies: Man Took Break from Video Game While He Raped Girl, 15

A witness told Pasco deputies that a microphone was on during the incident and he could hear the girl say “no.” Afterward, the witness and the suspect resumed their video game, Pasco deputies said.

NEW PORT RICHEY – A New Port Richey man is accused of raping a 15-year-old girl while he took a 15-minute break from playing a video game, the Pasco County Sheriff’s Office said.

Daniel Enrique Fabian, 18, of New Port Richey, was charged with two counts of Lewd and Lascivious Battery – Sexual Activity with a Victim 12-15 Years of Age. One count arose from this case. The other from an unrelated case.

Pasco deputies said the girl and Fabian knew each other. According to the arrest report, she told deputies that she went to Fabian’s home and while she was sitting on his bed, Fabian put his hand over her mouth, pushed her onto her back, and raped her. She said she told him four times to stop but he continued to have sexual intercourse with her.

Deputies said that a medical assessment by the child protection team at Pasco Kids First supported the girl’s allegations.

Deputies said a witness was playing the video game Grand Theft Auto with Fabian using his Play Station 4 the day the girl was at Fabian’s home. The witness told deputies that Fabian told him the girl was at his home and he was going to “smash” her, meaning he planned to have sex with her.

The witness said Fabian stopped playing the game for about 15 minutes but left the microphone on. The witness told deputies he heard the girl moan, groan and say “no.” After about 15 minutes, Fabian resumed playing the game.

Deputies said a sample of Fabian’s DNA from this incident was submitted to the Florida Department of Law Enforcement. A computer match was found between the sample and found a match with another Pasco County case.
